The Stateside Provisional Waiver, also known as the Provisional Unlawful Presence Waiver, is a crucial process for many immigrant visa applicants. This allows eligible individuals, particularly those who are immediate relatives of U.S. citizens, to apply for a waiver of inadmissibility before leaving the United States for their consular interview.

Expanded in 2016, the Provisional Waiver now applies to all individuals eligible for an immigrant visa and a waiver of inadmissibility. If you are a noncitizen needing to obtain an immigrant visa abroad, and you have more than 180 days of unlawful presence in the U.S., securing a waiver is essential before your return.

The primary goal of this process is to reduce family separation during the often lengthy visa application process. It offers a pathway for individuals immigrating as relatives of U.S. citizens and permanent residents, lottery winners, and existing immigrant visa holders to remain in the U.S. while USCIS reviews their waiver application.

Essentially, the Provisional Waiver allows you to address issues related to unlawful presence and seek a waiver before departing the U.S., potentially avoiding a ban from reentering for 3 or 10 years. This is a significant benefit for families.

Important Note: The expansion of the Stateside Provisional Waiver does not replace the Form I-601 process for those who don't qualify for the provisional waiver.

Exceptions to Unlawful Presence:

  • Spouses of U.S. Citizens: Certain exceptions exist for spouses of U.S. citizens.
  • Valid Visa Holders: Individuals who entered the U.S. with a valid visa may also qualify.
  • Expired Section 245(i): While expired, this provision may still allow some individuals out of status to apply for adjustment of status.

The Provisional Waiver provides a valuable opportunity for eligible immigrants to proactively address unlawful presence and minimize separation from their families during the immigrant visa application process.
